PDPA
The latest amendment to the Personal Data Protection Act just passed on 2 November 2020 strengthening the accountability of organisations, recalibrating the balance between individual’s consent and organisational accountability to use data for appropriate and legitimate purposes, while giving greater consumer autonomy over their data, and strengthening the effectiveness of enforcement efforts by the Personal Data Protection Commission (“PDPC”).

Sri Lanka PDPA
Sri Lanka has recently launched the Personal Data Protection Act, largely aligned to the EU General Data Protection Act (GDPR). This was certified by the speaker of the Sri Lankan Parliament on the 19th March 2022 and moved into law. Organisations from and operating within Sri Lanka are now required by law to become compliant.

The United States does not have a federal data privacy law that is similar to the GDPR. However, some individual states have introduced their own data privacy laws that share some similarities with the GDPR. There has been some recent movement in making a federal data privacy law, but this is yet to happen.

Malaysia PDPA 2010 (coming soon)
The Personal Data Protection Act 2010 (“PDPA”) is an Act that regulates the processing of personal data in regards to commercial transactions. It was gazetted in June 2010. The penalty for non-compliance is between RM100k to 500k and/or between 1 to 3 years imprisonment.
